Husband and I have been married for ten years. He met and married his first wife when he was 19. No kids, it lasted a year and a half. He is now 41. We were at dinner and a crazy woman came up to us yelling about "replacement". She started throwing stuff at us and being a general um insert the word. She then sat down on my side of the booth and asked if I knew who she was. I said "No, but you need to get the F*** away from me." I can handle myself, but she hit me. I told the waitress to call the police. But, I didn't know at that time that it was husband's ex-wife. Husband just sat there in shock that this was happening. I filed charges and plan to get a restraing order on her, but husband says it's just a chance encounter don't bother. I will go ahead with the charges of assault. But should I go out of my way for a restraining order?

Husband didn't not defend me. We we're just shocked that it was his first wife from twenty years ago. He defended me and was very worried. We just didn't know what to do when she showed up as a psycho.

No, this was the first time incident. Keep with the assault charges, but if she does this again, then yes on the restraining order.

Yes, nail her tail to the wall. To the Full extent of the law. She will learn her lesson the first time if the penalty is harsh enough. Don't take any shite from anyone...especially the ex-wife...and tell that man of yours that he needs to sack up and not let anything like that happen to you again. You were assaulted, cursed, challenged and forced to defend yourself while he sat back and watched??? He needs to step up and be a man and not let anyone attack you again. Why is he even considering protecting her by requesting that you not press charges and restrain her...is he wanting her back? Are they already having an affair? What made her come up to you in such a way? There might be more to her actions than you know...Watch your back girl...he should have never let her disrespect you like that if he loves you.

I would go on with the assault charges too, and a restraining order may help you in your case against her if she attacks you again. It won't stop her from attacking you if she wants to do it again. She sounds like she doesn't care, she will just go after you.
Why did your husband just sit there and not get up and protect you? He should have got up and knocked her out. Or at least jumped in between her and you. What a pud.
Be very, very CAREFUL!!!! She maybe 'fatal attraction crazy'!!! If she physically assulted you in a public place she is dangerous!!!!!!!!!!

Go ahead and do all you can to protect yourself and your rights. You never know .. if she can be this wild in the first encounter, you never know if she'll get crazier and stalk you or might even try and harm you on a larger scale. It might be a chance encounter, but she may continue to hassle you. You warned her to stay away,but she didn't. Perhaps, by taking the help of the Police, you can get across the message that you are dead serious.
Good luck, and I hope that female gets a life. (Your husband should have stood up for you, she's an ex, not a part of his life anymore. Why was he so stunned?)

Wow, I thought my husband's ex was bad. Considering that she assaulted you the first time you met her I'd get a restraining order. She is wacky enough that she might just be interested in finding out where you live to further the harassment. Not worth the risk to not get the restraining order.

I think the only reason I would side with your husband on this one is that when you file the charges against her for assault, it obviously documents the fact that she was there. Typically judges are not as inclined to grant a restraining order on a first time deal. Just keep the situation in check.

absolutely. she's probably twisted enough to blame you for her being arrested and might want to retaliate. at the same time people react to restraining orders in strange ways - some learn their lesson, some see it as a challenge. since you can't be sure whether she's been holding a grudge for 20 years or suddenly snapped, it's a good idea to have it in place just in case things escalate. if she does violate it in ANY way, make sure you follow up on it so you can establish a pattern.
even if it only ends up being for your peace of mind, get the restraining order.

Crazy isn't a strong enough word for this woman! I'd file the charges and get the restraining order if I were you. This could turn out like "Fatal Attraction" if you're not careful! Good luck, sounds like you're gonna need it.

I would go through the full extent of the law !! I cannot believe your husband's reaction to the situation. Get your restraining order !!!
And if you have the time and she has the money, sue her for assault ! You see this kind of stuff on Judge Judy and they get paid in order to teach the other person a lesson ! If you don't want the money, give it to a Charity.

I am sorry for your luck...that must have been horrible...a word of advice, get the restraining order, if it never amounts to anything (and I hope this is the case) it doesn't matter anyway,but if you need it... the law is all about paper work, and the more you have in place, the better the law can serve you...
