The judge would perfer you to sign, but they can grant the divorce it just takes longer. Why dont you want to sign? You need a lawyer to help you, if you need to work on the property settlement or other issues. But in the USA, the judge wont make a person stay married forever of they want a divorce.

It doesn't necessarily take longer. If the judge sees that there is no change for reconciling on his end... he could very well sign off on it within 30 days after he files. However, most judges won't. They will order that you both go to counselling for a certain amount of time. If he still decides he wants the divorce, the judge will grant it. Besides... why be with someone who doesn't want to be with you?!

Depending on the state you live in, no you won't get the divorce. You both have to agree to the papers and both have to sign saying that you want a divorce. Until you sign the papers if you meet a new man and want to marry him you will not be able to. My suggestion is to look over the papers, get a lawyer if possible, and if you agree to the terms of your divorce sign the papers and move on with your life. Otherwise he will keep bugging you to sign the papers. Good Luck!

Depending on the state, if a person files for a divorce and the spouse doesn't sign with in a certain amount of time then a divorce is granted through the courts...If it helps ask yourself "Do you really want to be with someone who obviously doesn't want to be with you?" If you answered no, sign the papers and save yourself all the extra drama....If yes, you might want to see a counselor, your worth more than that....good luck

It all depends on what state you are in. I imagine since you are asking, that you don't have a lawyer. I got divorced in Illinois without a lawyer. If you are in agreement with your ex and you have been separated for 6 months or more, you can get divorced as quickly as they can get you in to see the judge, which was 3 weeks in my case. It would have been two weeks except the judge was on vacation one of those weeks.

i don't believe it will be granted unless you both sign...when you go to court the judge should ask if either party believes the marriage can be saved and if either party answers in the affirmative than he will not grant the divorce.

If your husband was the one that filed (petitioner) and you were served, even if you don't sign the final judgment, your husband can still get a dissolution; its called an "uncontested" divorce.

Just sign the stinkin' papers. Its not going to make any difference in the end.

If you do not sign and you do not show up He will win by default. Because you have received the papers and are aware of the proceeding. It is not smart to ignore what's going on you could lose alot of your rights.

Unfortunatley, yes, you still will get divorced. It just takes longer and can end up costing more. It doesn't sound like you want this divorce. I am sorry........

Hello

I am from MA and my friend filed for divorce without her spouses signature. BUT she wasn't able to find him.

I do not know law but I would think it CAN still happen.
Good luck
