Rent.com publishes ad that clearly states upstairs unit 750 per month. Complex claims they do not honor the rent.com price because ad is incorrect. The ad is still posted on website with same listing and was posted the same day I filled out application and submitted check. Complex wants to charge me 800 per month. I have printed copies of May and June ad from rent.com website. I have requested the complex change rate to 750 but they are noncompliant. I really want to live there because my dad is having health problems and need to live close by. What should I do?

Did not sign a contract agreeing to the price just mailed in application and application fee. Never went out to complex sent family members. I live 700 miles away from where I am moving.

If you have the 2 printed copies of THEIR website prices take it to them if you haven't already. That's a little too odd that their site and the renter's site lists the same "incorrect" price. Find out what company owns that complex and call the manager of it and nicely explain about that and see what they can do for you. Good luck, $50 bucks is not pocket change!

I have a little different problem. The actual apartment I am seeking states that they have 3 apartments available for the price of $540 for each apartment. When I went to view the apartment, the lady stated that they don't know why that's on their own site but the actual price is $730 and maybe those places are already rented out. Continuously I go to check the site and those apartments are still listed (for the past week). I believe they are either blatantly false advertising a price, discriminating in some fashion or bias OR the lady did not know initially that I had researched the prices beforehand and once I challenged her on the price, she attempted to save face by telling me I was wrong.

What can I do for them to honor the price? My mom in law is on a strict budget and needs to find a cheaper apartment to live in ASAP.

The complex isn't completely responsible for what rent.com posts on their website, as they aren't in control of updating numbers and information. All they can do it contact them and wait for the change to be made. Maybe you should call the apartment complexes in advance before sending them money for an application fee. And if the extra $50 is going to put you way over your budget, look for a less expensive place that is close by.

Are you talking about a difference of $50 a month? Why don't you ask if they'd be willing to compromise at $775 if you sign a six-month lease, then? I'm not sure what the penalty is for the ads, although most stores can post signs saying the price listed was incorrect, but I wonder if the hassle of lawyers and court would be worth it. Can you find another place?

It does seem a bit sleazy to me, but I don't know if its worth the fight. I'd say just pay the $800 or go somewhere else.

Since you clearly were aware of the actual price before signing the contract I'm not sure if you have any legal recourse (of even if legal recourse would be worth it as the complex may get mad and not rent or re-rent to you).
