Not certain about the law but considering the RAPE issue I'm sure they would be put in a place with the least likelihood of that occurring(the prison for their current gender.) to force the issue and make a MTF transgender go to a male prison could arguably be considered cruel and unusual punishment.

Honestly, in the US, trans people have very few legal rights. I don't like being pessimistic, but I'd think they'd get put in the prison of the gender on their birth certificate. Law enforcement tends to not be the most open minded group and they'd probably do it as a form of harassment for their own entertainment.

I dont know where you are from but here in England it doesnt matter what your birth certificate says what you were born. If you have had surgery from male to female or visa versa you go to the prison of your chosen sex. For instance if you had surgery to become female then you go to a female prison. But if you Live here now you can have your birth certificate changed to that of your chosen gender. If you want more info please mail me.

NOPE! Nice try though! Your criminal record STAYS WITH YOU FOR LIFE. You will have to answer "yes" to the question about convictions FOREVER, because it will come up on the background check -- and if you say no and they find it, then they get you for lying on your application and terminate you immediately. If it was a felony, it can never be removed. If it was a misdemeanor you can pay a lawyer to "get it expunged", but it can take a few years because it has to go thru the court system. Either way you're basically screwed. In this economy... NO ONE hires felons. Not even McDonalds. Good luck.

It varies. The piece of paper usually isn't the determinant. Like the sign on restrooms at a lake says, he or she an outboard or an inboard? A born-male with no penis usually goes to an isolation lockup at the male prison or the female prison--it varies from place to place. Anatomy trumps the paperwork almost, but not always, every time.

They might go to the prison of their birth gender and be placed in protective custody while in there to prevent them being harmed by others.
