Is there a way to get everything he owes me now.

2007-06-04 15:55:48 · 12 answers · asked by Animal M 1 in Politics & Government Law & Ethics

He has been order to pay an extra 250.00 per month on top of what he already owes. but he stoped paying the extra and is barely paying the monthly. He has the money. He doesn't want joint custody, he doesn't know his child because he doesn't want to (she is 12 almost 13). The reason I want the money he owes me because he just told me he is getting married, which he is paying for, and his soon to be wife has a son who he wants to take care of. I believe he should take care of his own child before he starts taking care of his step child.

Your state should have an office that handles the child support payments. They are the ones who send the checks to you. Contact them and ask what can be done. Most states will pull a person's license for being behind on child support. The amount owed is more than enough to get their attention.

If you can not find your state's office for child support, contact you Clerk of the District Court's office in your county courthouse.

Go with Romare's answer by contacting the D A's office and let them provide you with free legal representation and they are the one's who will prosecute. But ,don't get your hopes up unless ya know he has 20 grand to pay ua off with cause there is an old saying about "getting blood out of a turnip"

You will need to have another support hearing to make arrangements to have the arrearages paid to you over a period of time. Your ex-husband will not pay anything extra unless he is ordered to pay it.

It is time to have your attorney take him to court, analyze his income in accordance with support guidelines, and make a determination of how much he can pay.

If your thinking about getting the lump sum of $20,000 then the only way would be for him to get a loan for that amount to pay you off. But if they turn him down for a loan, your probably going to have to settle for monthly payments, if he can afford it. Good Luck!!

You need to call the district attorney's office with your divorce decree and supporting papers in your hand, describe the problem to them and ask them to go to court on your behalf to collect the money owed.

As long as he has the money, is working, has assets.....go for it! Nothing worse or more shameful than a dead-beat Dad. He should consider his actions to be "stealing from his own child / children"; which is despicable.

Yes, you should be able to get back child support but you would need to file a complaint and possibly go to court.

Better still--why not just knock off that twenty thousand and give the guy a fu##ing break, your greedy question wreaks of selfishness.

Be happy the law allows you to get anything at all---You wanna de-burden yourself---give him joint custody.
