Can I file a lawsuit against Yellow Cab of Houston for being involved in an accident where I was a passenger? What happened was a pickup was cut off by a bobtail rig and the pickup lost control on gravel on the shoulder and came across the centerline where the cab I was in (sitting in the front passenger seat) couldn't stop in time and hit the pickup. All I saw was a cut on my knuckle, but a day later I'm experiencing neck pain. Can I sue the cab company? And if so, would I be able to settle it out of state now that I'm in Iowa and it happened in Texas? It happened 6/3/07

Most likely you could sue, but you need to get in ASAP to see a physician and get your pain documented. You will need to obtain a copy of the police accident report, it is most likely that you should be suing the the pick-up driver's insurance company, and not Yellow Cab. It would be hard to prove that they were at "fault". You should be able to obtain the pick-up drivers information from the police report. Give all of the information to your insurance adjuster, and they will handle the claim. If not, get an attorney. Being out of state will just hinder the process time wise, there is no reason you can't proceed.

It's not the Cab Company's fault. They didn't cause the accident. You will have to find out the person who caused the accident and then maybe sue them for any damages. You'll probably have to claim the accident in Texas if that's where it happened.But you shouldn't leave it too long, look into it right away.
