the only problem is she wants to take him 2 the cleaners.Hes offered to give her the house the car and all the contents and take care of all their sons needs and wants.he just wants her to leave his stocks and bonds and half of his retirement alone. does anyone have some good advise on what he needs to do about this situation

You should be worried by this. First of all, you have been dating a married man (separated is still married, you know). And if she is that upset with him that after two years she still wants everything, then he has cheated on her before, too, probably. You've only heard his side of the story, so you are thinking she is a nag, a hag and worse. Take a step back and really look at him. I'll bet you see that there are two sides to every little divorce story. He has a child..what kind of a Dad is he? Look carefully. What broke up their marriage. Look again. As to the settlement, if he has a good lawyer she won't be able to get all she wants (she is trying to get a FAIR share, so she is asking for more than she really wants...that's what lawyers do...they have clients ask for the moon in order to get a fair share). In most states, the wife and husband splits their assets 50-50 or at least 40-60. That means she has to give him some of the equity in their home (her share of stocks and bonds). The lawyers should be able to work it out if he hasn't been a read cad.

Wellso far what you mention he is giving her is exactly what the state will give her anyway and nothing more or special. The Judge will make sure the boys best interests are taken care of first and foremost above the parents. He can take a chance and go into the court with what hes willing to give and see what the Judge does. If h feels the split is equalamong both then he will approve it. Take the chance.Good luck

First, ignore those calling you a homewrecker. They don't know the entire situation. You may be a homewrecker, but if he was already separated before you started dating, you did not cause it. That being said, you need to put this relationship on hold until he does settle everything with his wife. Take is from someone who has been through it a few times, it just is NOT worth it. He needs a good attorner and you need some good distance from them. Remember...there's a reason she's so angry.

if hse is smart she get a attorney
and if he is smart he'll get a attorney
and unless she agrees with her lawyer present to his conditions, he will have his retirement and stocks
but that's a snowball chance in hell of happening as any good competant and agressive divorce attorney will got for it all
that is...

force sell of the house ( or 1 buy the other out )
1/2 of his pension
1/2 of his stocks
alimony
child support
as if he aquried any of this during their marriage she is entitled to community property ( and thus 50% of everything )
and the alimony is also determined by the length of time they were married, child support and custody will also be determined
it's going to be messy, painful and emotional for both sides
cheating by having a GF has no bearing on the divorce either
you failed to mention what state you live in

You need to lay off of married men then you wouldn't be online begging for divorce settlement advice.Whats wrong? you afraid your bf will suddenly be broke all the time? It serves you right you house wrecker.

terrysgirl0206 in most states,infidelity does not lead to a bigger divorce settlement.Whoever told you that misinformed you.My buddy's wife ran around with an 18 year old kid and he had pages upon pages of photos she posted online as well as emails and messages she left on his myspace account and he still got the shaft in the divorce settlement.None of the evidence he had was admissible
in court.

There is no easy way to get around this if she will not agree on who gets what. He will need a good lawyer to defend his assets. If he really wants out just bite the bullet and get it over with.
