Im 20 years old and in December I was involved in an accident with an 18 wheeler. I was the driver but it wasnt my vehicle, it was someone else's. Now the driver of the 18 wheeler is sueing me, the owner of the vehicle, and the name of the person that the insurance is under ( which is the owners dad) The driver of the 18 wheeler is sueing for "mental anguish" This type of deal has never happened to me before and Im really stressed out about it. I dont have any money which is of course is what the driver wants and what do you think is going to happen?

Although it is going to cost money, I strongly recommend you find yourself a lawyer. It's unlikely you are going to get good legal advice on Yahoo.

Take a look through your yellow pages, or search through the net for your state for a legal aid office. They can provide you with the name of a lawyer who might take your case at a significantly reduced rate, or for nothing at all. If the driver of the 18 wheeler is bringing a frivolous suit you may be able to recoup your legal costs by requesting from the Judge that the plaintiff reimburse you.

He's obviously hoping to get money from someone, which is why he sued everyone. Without knowing any of the conditions of the case I couldn't begin to try and give you any detailed advice, so your best bet is to try and aquire legal aid.

What will probably happen(if you get a lawyer), is that he will move for a preliminary hearing, where the plaintiff will be required to provide all evidence that the suit is justified, and the judge will decide whether to proceed. If he's just decided that he wants to sue you, and he has no proof of injury neither trifling or passing, then the case would be dismissed.

First of all, you had best ignore all of the answers which suggested you won't be harmed. The 18-wheel driver is well within his rights to sue all parties involved.

And because you were driving, you will share in any negligence. That's why you carry insurance. So that you are covered not only for the damages, but also for legal representation.

At this point, the father has insurance. If it doesn't cover you then you had better hope that your negligence doesn't rise to a point that affects your future.

A judgement against you in this matter, depending on which state is involved, could last up to 20 years with 10% interest on any unpaid balance.

And yes, I am an attorney. I suggest you find one for yourself fast.

I don't think much will happen to you but the owner's dad may have to pay something because the driver of the eighteen wheeler will go after someone with money and since you don't own the vehicle it might lay on the owner's shoulders to pay.It looks like you may have to pay him back if he gets sued but you should really seek councel and if you can't afford an attorney then check with legal aid...good luck and i hope everything goes ok.

Your insurance co. will be sued. You will just endure the anguish. Unfortunately we live in a lawsuit happy world and the bottom line is that is why our rates keep sky rocketing. Frivolous lawsuits happen everyday..Don't take it personally it will eat you up!

Just noticed you don't have insurance!Get some before you drive again and keep in mind that the owner of the car will end up paying any increase for this accident due to the claim.

dude get a freaking lawyer im serious or call in on one of those radio talk shows where the host is a lawyer and they answer your questions.
