My husband is in the army and I am considering divorce. Who is most likely to get custody? does the military allow alimony in the situation that I have no education and I have a 2 year old child. I will not have the money to pay for an education or child care if I am working a min. wage job.

You will likely get custody, but unless you have been married many, many years you will likely not get any alimony and as you know, support won't be much as he is in the military.

All I know, from what you have said to me personally, you need to get this going and get somewhere safe. That child is top priority and what you are going through is damaging this child. Luckily also, with a child you can get alot of help in paying for college so that shouldn't be a huge worry. The government offers tons of grants and help so you can get the education you want.

Just be safe and keep that child safe.

first, the military has nothing whatsoever to do with your divorce. They do now have anything to do with custody and nothing whatsoever to do with alimony.

Second, although he may have to go back to Iraq, that fact can be changed. Especially if he wins custody. Everything at this point is a matter of fact for the court to decide.

As for your SPOUSAL SUPPORT, (alimony) is to place the awarded spouse in the same position that she would have been in had the marriage survived. I doubt seriously if you will be awarded spousal support and even if you are, permanent support is very rare these days.

What will be most likely is that you may be awarded an award for six to 12 months to get on your feet and get the training you will need to get a job.

You will NOT get to sit on your rear end and let him pay the bills. Courts are funny that way. They want BOTH parents paying for the support of the child.

By the way, what do you think the military is if not a minimum wage job?

Unless youre ruled unfit, chances are youre going to get custody,the house due to the child,child support and possibly spousal support too
