Well, hopefully he will go to jail that would be ridiculous for him to get probation. You should be able to have a say in court at his sentencing, bring the grandparents along to so they can explain how they feel about his sentencing.

I am so sorry that you are going though this. As a parent I can understand how you must be feeling.
Depending the state where you live he should get the maximum sentence allowed by law. No judge would want to be known for being light on this heinous of a crime. I am not sure what kind of plea bargain a DA would offer this scum. Be assured the likelyhood of probation is quite low unless he can supply information that would lead to the arrest of a much bigger crime. I could not see any crime being worst than what has happen to your daughter and for any judge to give probation for this would be gross misconduct on the part of that judge.
I believe that you can file charges or sue the judge if your worthless X does get probation - check with an attorney.
Another thing that may or may not help your state of mind - guys like him do not make it through a prison sentence easily - other prison to not take kindly to people who hurt children.
You should get some counseling, if you have not done so yet. It will help you to learn how to cope with this tragic event.

Don't worry. It's highly unlikely that any DA would plead a charge like this down to probation.
Now, if the plea bargain is a minimum of 7 years, the least he'll serve is 3.5, realistically. Now, if he's screwed up enough to do that to a child, he'll probably not be able to count on "good time" that will cut his sentence.
If he chooses to not take the plea, he'll likely be sentenced to at least 10 years.

You should be directing this at the DA's office, they are the ones who will be handling the plea bargain agreement. Make your wishes known that you want to see that scum bag do time. Also, have everyone in your family contact the DA's office. Getting a hold of a talk-radio station and having them discuss the case would help.
I really don't think a judget will let he get away without doing some time, but it can't hurt to let the DA know how you feel about this.
Also, if he has any real money, sue him in civil court on behalf of your daughter.

The probation report should reflect the impact on the victim, who in this case would be speaking through her mom. Call the ADA who is handling your ex's case and ask how to have your views reflected in the report.
It sounds like he will go to prison. He will need to be in special housing, because like Paris Hilton, a lot of inmates will want to hurt or kill him just because of what he did. He will spend his time behind bars watching his back and fighting for his life. The fighting will reduce or eliminate the possibility of an early release.

You said it yourself. You said that the "plea bargain" is anywhere "from" 7 years to probation.
It sounds to me that he is going to "prison"/"jail" for 7 years; and after possibly probation.
Doesn't sound me according to what you are saying, that he is going to walk on this.

Go immediately to a lawyer. Make sure that he never ever has any chance of getting next to this baby again. You are the guardian and protector of this helpless child. It is up to you to make sure you never let this happen again. You are the victim for the first time only. If he harms this child again, you are as guilty as he is. If you have to move and start over again, then move. This baby, like you, only has one life.

You should speak to the district attorney to see what his thoughts are on sentancing. You should also see if you can adress the court pre-sentancing as a victim impact statement.
You might also consider civil lawsuit against him for damages of the assault.
