First, try asking the neighbor if you can remove it, or spray it with a product for killing poison ivy, I believe Ortho and Roundup both make a product specifically for that. Legally, in most areas, you can remove any part of the plant that crosses over the property line. If your talking to your neighbor doesn't want to work with you on this, you can possibly try legal action if you can get proff that you, or other members of your family have bad reactions to the poison ivy. Of course, legal action is a last restort, will cost a lot of money for a lawyer and court fees, and can create friction between you and your neighbor.
Seriously, though, try talking to your neighbor, as they may not know it is poison ivy.

I bought some stuff at the local farm store called "Scorcher" which is made by "Enforcer". It's a vegetation killer that comes in a red jug. We bought this house and found a layer of poison ivy behind the garage three feet high and six feet wide. The darned stuff had even vined up the side of the building and had started taking over the roof. Thick, old growth vines too. I mixed that "Scorcher" a bit stronger than what it called for, wore protective clothing, and sprayed that mess with a pump sprayer. It wiped it out, except for a couple of tiny spots which I hit again a couple months later. None's come back since for three years, which is good because I'm horribly allergic to that vine.

Ask your neighbor if he/she mind if you trim the poison ivy back, on your side of the fence, so your little one won't get into it. If they give you a hard time, then go ahead & do the deed. At least you spoke to them about it. Some will say it's on your property, so remove it but to be a good neighbor, discuss it with them just the same.

Cut the tips off the ends of some of the limbs and dip them into a cup of full strength Round up and let them stay in there for a couple hours. . Systemically, it should travel down to the roots a kill the whole plant and no one should be upset about losing a toxic weed that causes so many problems. Be sure to wear gloves and wash your hands with lots of water afterward Hope you get this resolved! (Try your county farm advisor)

It's possible your neighbors don't know the PI is there. Why not talk to them about it? Offer to take care of it for them if necessary. In any case, Round Up will take care of the problem - even if you have to spray it through the fence from your side :)

Check with your county extension agent. There may be a weed control ordnance that cover poison ivy.

chop it because its on your side. you legally can do that.
but here's a funny story. my sisters neighbor's has a tree that hasn' t been cut in decades, it drops so many damn leaves on her backyard that there was always more of a mess on her side than the neighbors side. so my brother n law went out and put up a tarp (that looks rather nice by the way) at an angle so when the leaves and needles fall they fall on the tarp thingy and sliding down into the neighbors backyard HAHAHAHAHAHAHAHAHAHAHAHA...so no more mess!
and get this..THE NEIGHBOR actually had the nerve to CRY ABOUT THIS! saying that it was leaving a mess in HIS backyard now. the city told him to cut the tree because its in the phone lines and all..but he's trying to fight it. anyway...just a funny story how my sister and her husband got their little revenge and a clean back yard

As long as it's in your yard you can do whatever you please. Your neighbor cannot control what you do within your own space. Either spray it or put a different type of fence that it could not come through.
