I have had to deal with this several times. I will respond to any possible weapons offense on face value. Most police officers will. Just because you have an orange tipped toy, does not mean the responding officer knows it is a toy. I took a very real Beretta 9mm pistol off of a perp (he was 19 but looked 15) that had the end of the barrel painted day glo orange.
Your best bet with Air soft is to have fun, be safe and if confronted by police, immediately drop the weapon and show your hands to the officer. Do EXACTLY what he/she/they tell you and you will go home safe. If not, you may go home in a body bag.

Step two. never..NEVER sight in on someone who is not playing.
Step three. At the FIRST sign of law enforcement drop the airsoft, keep your hands in the open and do EXACTLY what is asked of you.
Anything that may darken or obscure the orange tip may prove to be dangerous. Law enforcement officers when they respond to reports of an individual brandishing a firearm are very tense. Do not do anything to make them more tense.

Frankly, it depends on your local laws, your ages, and your neighborhood.
There are 2 kinds of criminal laws: mala prohibita (illegal due to prohibition) and mala en se (I think I got that right, that means illegal in and of itself - like morally really bad).
If you are not damaging property or people, you are really not doing anything mala en se. However, when outdoors brandishing a weapon (even an orange tipped one), the neighbors might decide to report to the police a disturbing the peace complaint. (The strange part is, you are not disturbing the peace until someone complains about it.)

some old idiot may indeed call the cops and they may come out and investigate (especially these days the media has them all hyped up, sitting home watching t.v. with nothing to do). no big deal. just be prepared for it - be polite, respectful and cooperative if they do show up.
