I was forced to get married 6/27/2005 so my spouse could obtain legal documents, hes been gone for almost 2 years and i no longer want to be married to a person who i know is going to abuse me when he returns, i want to file for divorce with out his aproval because i know he is not going to want the divorce, i got married in new orleans la and i live in orlando fl and he lives in managua nicaragua , i do not want to be married to someone i dont love especially after being forced to get married any advice?

he was in the country as an ilegal immigrant , i am puertorican therefore i am an american citizen he saw me as the perfect opportunity for a green card , the relationship was short and aggressive at first , and he made me marry him based on all these threats

Be careful...he doesn't sound like Prince Charming. You might want to MOVE before he gets back and change your name back or to another last name (I know, sounds overboard, but you don't want him being abusive toward you).
Also, do a credit check on YOURSELF. Sounds like love was not the motive that made him want to marry...make sure your credit hasn't been ruined by loans or credit cards that he got in your name or jointly, without your consent.
When I first said document, document, document...the reason taht I said that is because you need to have your facts in a row before you proceed.
Has he ever written threatening emails to you that you still have? Has anyone ever seen him be confrontational to you? How has he threatened you? These are things you need to think about BEFORE you file, so you can include them in the arguement for divorce.
Also, you should try to get it ANNULLED, not just a divorce. Annullment will not scar your record or link you to this man any longer..and will make it an easier life for you in the future. With a divorce, you will have to provide documentation, etc, for a long time if not the rest of your life, in certain situations.
I wish you luck...but most of all, I pray for your safety. Divorcing a controlling, abusive person is not easy. Be ready for a fight...and make sure you have a good support system around you when you do.
I might also suggest this link: www.divorcecare.org which is a national group that has meetings in every city. I found this to be especially helpful in my divorce. I am sure they have many different groups that meet in Orlando.

Do not admit to anyone that you married them just to get them in the country, that's a no no. Just go file for divorce on grounds of mistreatment and at get a restraining order at the same time.

Are you saying you broke immigration laws by marrying someone so they could get documents to live in the U.S.? And you haven't lived together since? You'd better talk to a lawyer quick...

File for a divorce and get a restraining order if necessary. I don't understand the forced part, but if that is the case, and you can prove it, you can have the marriage annulled.

Contact a lawyer. There should be a means of getting the marriage annulled, or perhaps there is some other legal action you could take.

Get his address and file for a divorce in the state where you live. They will send him the subpoena and if he does not show up to protest the divorce you will be good to go!

No problem. You are already leaving apart for about two years.which itself is adequate ground for it. The legal documents are presumably for citizenship status of the country(You are probably a Nicaraguan).If he refususes you can threaten him withsquealing which may cancel his citizenship status.He will come round.

contact immigration and naturalization service in your area and explain your situation. they can put a hold on his return while you get the marriage annulled. seek out legal services aid and they will help you do the paperwork to have the marriage annulled.
