What does an an affidavit for non prosecution entail? Briefly police were called, argument got out of hand, spouse was asked to leave the residence, police came back to house, spouse had a warrent for a hot check from 11/03, arrested spouse and then, charged the spouse also with family violence and was arrested with both charges. I now have to go to DA in Bexar cty, Texas, to fill out an affidavit for non prosecution, before court date this week for both charges. What can we expect to happen? Thanks for all answers in advance...

You have nothing to do with the hot check unless it was written to you, so you won't be filling out anything on that one. However, for the other one though it means you don't want to press charges, however they can still press charges even if you don't want them to. This is the case because it's of public interest to prevent assaults.

You shouldn't sign it. By signing it you are enabling her behavior. You need to get out of the house & live either on your own or with roommates. Your mom needs help & you should advise her that she needs help. If she truly values any relationship she has with you, she will go to rehab. Let her know that you cannot have anything to do with her until she cleans up & finishes a rehab program... At least 30 days as there are definite abuse issues there. This will not be easy, but if you want to help your mom & break this vicious cycle, it is what must happen. You are worth more than that & you are entitled to start your life, abuse free, and to attain the happiness that you work for. I will pray for you.
