In a divorce you have a petitioner and a respondent. Petitioner files the divorce, respondent is the other party.
If it is a uncontested divorce the respondent does not respond. Uncontested means both parties agree to the terms of everything. Child support division of property and division of asassetsts and liabilities.
Most states you can do a pro- per/pro-se divorce
do it yourself.Especially if it is a uncontested divorce. Get the forms and directions from the court or even off line.

One usually initiates divorce proceedings. At that point, the other party usually goes to a lawyer and files papers of their own to contest what was filed by the first spouse.

Nope, not a dumb question. One can initiate it (although both can file if they want) is this a mutual thing? sounds like it if they're wondering if one or both files.

Either one can file, even if both parties agree to the divorce. It doesn't really make any difference which party does it.

As far as I know one initiates it. I'm going through one right now pro se and I had to pay 300 bucks just to file. It doesn't make much sense to me that both would pay that much if they didn't have to, ya know?
