I had tenants move out. The lease states no smoking in the house. The place reeks of smoke and there are ashtrays filled with ash left behind. There are burn marks in the carpet, but not enough to have it removed. They weren't supposed to put holes in the walls either, but there are large holes from shelves, speakers, and furniture. How do I charge for this from the security deposit?

I would replace everything, all carpeting, all window coverings due to cigerette smoke. Discusting. You have to get rid of everything to get the smell out, as well as repaint the walls and ceiling.

You can charge for large holes if they actually require a patch, but a little fill from a picture hanger is normal.

Get it repaired and cleaned up. Subtract the costs from the security deposit and send him the balance within 30 days with a listing of the costs deducted. If the deposit isn't sufficient, include a bill for the balance due and a demand for immediate payment.

BTW, a SINGLE burn in the carpet is full justification to have the carpet replaced at his expense. It is NOT fair wear and tear. This would be the case even if you didn't prohibit smoking. If you can't get the odor of smoke out of the place, you may have to have it fully re-carpeted and painted at their expense of course since you did prohibit smoking and they broke the rules.

Holes in the wall are a bit of a weak one, though. Holes for normal wall hangings such as pictures and shelving are reasonable and are usually considered fair wear and tear even if the lease prohibits them. The general rule of thumb is that if you can patch it with spack or patching compound it's fair wear and tear and you'll have to eat the cost. If you have to have it repaired by replacing pieces of drywall or using screen or tape that would probably be more than fair wear and tear and would be chargeable to the tenant.

Have it all repaired and charge them what it cost to repair.

Give them an itemized statement of each thing and the repair cost and send it to them with any remaining deposit.

I would also suggest you take pictures of it before you repair it all.
