We have been seperated since 2003. He has now been arrested with buying cocain from undercovers.

He has been before the grand jury and he must now put in a plea.

Now that it is on record that he uses dope does this now mean he can NOT have unsupervised visits with our children?

Also if he goes to jail or prison does this mean I can get a Free or Cheap Divorce?

And if we do divorce will this now allow me to have FULL CUSTODY without a Battle?

We reside in Ohio.

Please help as much as you can... ONLY serious Answers, please!

It only mean supervised visits if you go to court and have that ordered. The court he is going through won't do that for you.

You will still have to file and pay for the divorce.. him going to jail doesn't mean you get a free or low cost one. It only means he probably won't contest it which will make it cheaper. Though if he can get a lawyer he can still fight from jail.

If you file divorce and he is in jail then you will be able to get full custody.

I am not for sure if you can get a free or cheap divorce actually I doubt it. But I do know that you can and will get full custody of your kids (assuming you don't have any bad skeletons in your closet such as drugs, prostitution, all that stuff) I live in KY almost in Oh. I know there is not a judge in the world that would rule in his favor. I also think that if you wish for your kids to have only supervised visits the judge will rule in your favor as well. Giving the circumstances it is really in the children's best interest. If your ex goes to jail which is quite possible, than you want even need to take the custody thing to court. good luck to you!

Call an lawyer. I'm not sure and the laws change state to state. Clearly you're on a budget. Most lawyers will answer your questions by phone or have a initial consultation for free.

Get a lawyer. My best friend's daughter's father went to Federal prison and the judge ordered 1) no child support while he was incarcerated 2) for her to accept, on her dime, one phone call/week from him. Nice right?

You should have had an attorney on this since 2003 but you definitely need one now.
