How about:
You didn't live up to your part of our agreement so now I have to seek out side help in straighting it out.
But you should state the agreement & how that person didn't keep it. Also a general idea of the steps you will be taking.
If you will be taking legal action it would be best to have a lawyer draw up the statement.

I would say, The agreement that we made together was broken and I have no other choice but to take action. Or, You broke the agreement that we made and consequently I am forced to take action.

Sadly, I have to admit, I'm on the other side of that conversation. And I find it difficult to discuss my failure. I don't want to admit that I can't do as I said I was going to. I have not given up, though it may not seem that I am making the best decisions or doing the right thing I really haven't forgotten what there help has meant to me. I would not have survived without it. If I we in your shoes and to avoid losing a friend to this. Perhaps give them an option that they can afford to comply even if it seems small it may get them rolling in the right direction. good luck.
