say this person was antagonizing you and threw the first blow. How much can you fight back? For example, a guy comes up to a car window and starts yelling at him to come out. The guy in the car comes out and tries to calm the situation but the antagonizing guy starts throwing punches. Then say the guy being attacked starts fighting back and beats the guy down. Can the guy in the car get in trouble if he were to say.. break the guys face in the process of fighting back? or breaking the antagonizing guys leg or something?

I had a similar situation. I was threatened, a bottle thrown at me and I ended up coming out on the winning end. Thing is, though it was self defense, I went to prison. In my opinion, people do an awful lot of large talk except when it comes to getting beat in a fight they started. There arent many bounds, unfortunately, for self defense, and the defendant is usually in the wrong if the courts consider it excessive. Get an attorney, A.S.A.P., and if you believe it was true self defense, take it to jury trial, we still have that right in this country. Good luck, try to stay free of the legal system, thats the easiest way to live your life.

Self-defense is a defense against a crime, however you still committed a crime, 242 PC; Battery.

I would say it's acceptable to use force to overcome the danger, and nothing further. If you punch the attacker in the face, then kick them in the stomach after they fall down, I would consider that to be excessive and out of the bounds of self-defense.

You are right. Self defense has been used in so many assault charges, and usually it is brought out by the perpetrator, the one itching for the fight, and wanted to commit suicide by getting beat up.
Drive away if you can. Call the police if you can. Turn on your cars videowebcam and record the whole episode. SIgh. You ought to invent such a videocam. I know they dont exist.

If the guy initiated the fracas, then you are obligated to seek the best recourse to end it, in order to protect your safety. Gone are the days when a man took an A--- kicking and moved on. They break the law then expect protection by it!!

what if he doesn't leave a mark on you and yet you leave a mark on him.
you go to jail.

best to have witnesses and hope he leaves a mark on you or your in big kaka
