can my homeboy and his girlfriend still get kicked out if her name isnt on the apartment lease but they have a baby together and she is staying there also if they dont' feel safe in there resident for what ever reason can they break the lease without getting charged or having it put on his renters record

Not exactly sure what you're asking, but I'll take a shot.

Most leases require that all adults living in the property be listed on the lease. They cannot require you to list children individually though they can ask how many will live there as some communities have occupancy limits.

He CANNOT be evicted simply because she's having a child. However, if he has moved his girlfriend in and she's not been cleared by the landlord and added to the lease they both CAN be evicted if she doesn't move out when ordered to do so by the landlord. Some communities do not permit evictions for that reason so you should check local laws and ordinances.

They cannot break the lease without penalty unless the landlord has violated the terms of the lease. Failure to make repairs to items that affect the fitness for human habitation (heat, water, sewer, utilities, etc.) or safety (broken exterior doors and locks, broken windows (not broken by the tenant) unsafe stairways, etc.) are all reasons to break the least if the landlord fails to make timely repairs once properly notified. A case could also be made if other residents are acting in a threatening manner or are engaged in illegal activity such as drug manufacture or dealing, prostitution, etc. Simply not liking the place or the neighborhood are not going to cut it, though.

The answer is yes, they can get kicked out if her name is not on the lease. A lease is a legal binding contract and if not followed the landlord does have a legal right to kick them out. The landlord is also legally obligated to give them an eviction notice and time to find another place to live. That amount of time varies from state to state.
