I want to know if my friends boyfriend and her are staying together and her name isn't on lease can she get put out if they have a child together

secondley if she does put her name on the lease will the rent increase because they have a child
and also can a a manager increase the rent if 2 people are married and living together

I hope the way I worded this makes sense

Also if you don't feel safe in your residence for whatever reason can you break your lease with out incuring charges?

In many jurisdictions she can be evicted if she's not on the lease. Check your local laws and ordinances.

Merely having a child can't trigger an eviction or rent increase.

Getting married and moving your spouse in can't trigger a rent increase unless the lease specifically provides for that. That would be unusual though. I've never seen a lease like that -- and it may not even be legally enforceable in some jurisdicitions. You would have to notify the landlord that your spouse was moving in and provide their name on request.

If the reason for not feeling safe is caused by the landlord or is something that the landlord can reasonably correct then you may have a case for breaking the lease. Such things as broken exterior locks, doors or windows, as long as it's not the tenant's fault, are reasonable cause to break the lease if the landlord fails or refuses to make the repairs. Additionally if you are being threatened by other tenants without good reason or other tenants are engaged in illegal activities that threaten your safety you may have a case to break the lease. If it's simply a rough neighborhood you would have been expected to know that going in and that wouldn't be a valid reason for breaking the lease.

If her name isn't on the lease to begin with it is possible he could be evicted. Normally rent isn't increased with a newborn baby, but they can increase rent for any reason at the end of a lease. Also, two people married shouldn't cause a rent increase. The legal issues of breaking a lease are a bit complicated. But talk to the manager immediately, get things taken care of to make it safer because the longer you take the law would more likely support the landlord. .

The lease agreement should have it in writing if the landlord raises rent for the reason of more occupants and the amount should be in writing in the lease agreement, other wise if its not stipulated in writing then its not enforceable and you could sue the landlord or move out on the technicality that he ''breached'' the contract if he does anything that isn't stipulated in the lease.

they can charge more if someone else moves in that is not listed on lease. they can also evict that person not on the lease. don't know about the baby though. as for breaking the lease if you have reason to believe the place itself is unsafe you can take it to court to get your contract canceled. but not if the area its in is unsafe. just if the property is unsafe.
