You don't say what state you live in and your rights may be different depending on where you are.

You said that your landlord is demanding that you pay legal fees for when you last went to court. If you were ordered by the judge to pay them, then you have to do it and the landlord has a right to demand it. However, if the landlord has a judgment against you for those fees and/or other money you owe, the landlord must follow the collection rules that apply to all creditors. Your landlord cannot call you in the middle of the night, or a hundred times a day, and the landlord certainly is not allowed to assault you.

If there was no court order for you to pay and you never agreed to pay legal fees to your landlord, then it sounds like you are being harassed in order to force you to move.

Your handicapped daughter has a federally protected right to fair housing. Your state may provide even greater rights to her.

Please contact your state's department of fair housing, your social worker and your lawyer to help you with this. If you cannot afford a lawyer, please call legal aid or the ACLU for help in protecting your daughter's constitutional rights.

How were you placed in a building with no elevator if you have a wheelchair bound dependent? You need to get a letter from a physician insisting that you be given a ground floor apartment due to medical necessity.

I am not lawyer, but I am almost positive that nobody can force you to pay their legal fees. If they take you to court, the legal fees go on their tab unless they bring it up in court that they want you to pay. In that case, the judge will decide. Tell him to take you to court, that way he'll get even more legal fees put on him, then the judge will tell him you don't have to pay, and he'll have to pay the whole thing.

Go to Small Claims Court and sue him for Mental Anguish,
and Back Pain for throwing you to the ground. Check with Fair Housing for more charges.

It is very cheap, and you can sue up to $7500.00.

If you have witnesses to the Assault and Battery, Go to the Police.

Go to "Aid for Disabled Americans"

Amicably settle the dispute with your landlord in order that there will be a good relationship. However, if no settlement is is reached, file a case of mandamus in court to prevent the landlord from harassing you.

If you are on welfare, contact your social worker and let her handle it.

Then, you and your husband go find a job. What makes you think that you can sit on your butt and collect welfare. You have a 2 parent household...there is no reason you can't work. Many, many single parents manage to work and look after their children - even handicapped....
