It's a poorly worded question as both C and D are correct since they are virtually the same thing. That's why you don't want to commit murder in places like Texas because you know there's a good chance you may end up dying. Contrast that with a place like Iowa that has no death penalty whatsoever. It would be up to each state's legislature then to decide that.

c or d, they are basically the same. States have the right to decide their penal code including the death penalty. It can be appealed to the federal level though.
