For the most part, water is above the earth..because silt has created an impermeable layer....
But the earth is porous, and so gravity works to pull water through the porous areas

The earth isn't really above the water....

Most of the Earth's water is in the oceans, which cover about 3/4 of the planet. This water sits on top of the rocks which forms the Earth's crust. However, because the Earth's crust is quite rough and irregular some bits of it (the land that we live on) poke out through the water.
