Of course, the real reason they are said to perform a legislative function is because they are allowed to get away with dictating what the law must be, such as in Roe v. Wade.

3 is false. Congress only has advise&consent authority on Judicial appointees. (though the democrats have been stretching this lately)

Since the Supreme Court has the ability to declare a law unconstitutional, that would tend to make one think that it would determine the effect of a law.
