If you had the car before you filed for divorce, then you can't because it is community property... but I would go to court and file for an emergency hearing stating that you require transportation and the vehicle is in your name and requesting he return it asap.

Ok if the car is in just your name then yes you can call the police, but if his name is anywhere on that contract or title then your out of luck. It doesn't matter if you are still married or in the middle of a divorce I did it to my ex because he ran off with my car and he didn't return for a day or so. If i were you make the report ASAP. Because the longer you wait the more the cops will probably question why you didn't call sooner to make the report.
There is always the possibility of him being a bonehead in the middle of the divorce if you do but I feel that some of them dig their own graves. And when the lawyers go back and forth then that would be something to bring up and have him explain to the courts, yes it makes him look bad but then they will know what kind of person he is for not being a responsible person. Try to get trough divorce as the best person you can be, reporting it stolen will just show you as a inmmature person (as far as you know he took it, try to locate him and ask for it back).
Think further (are you getting a better seattlement if you take your anger with your husband handled like this?) and you'll get better things from life!!

You can, and if you're not living with him they MIGHT do something about it, if they have nothing better to do, but be prepared just in case they bring up the fact that you are still married and technically, until the divorce is final, whatever was purchased DURING the marriage (if your car was purchased doing and not before) is half his...until the court decides or grants otherwise.

Of course you can report it stolen. It's yours, it may be a case to face if he has made payments and decides to take you for court. Well it is the weekend though...unless he has to work the weekend, he can't take you to court for any losses. He is responsible for not bringing it back. have you called him and told him to bring it back. If you have, you have nothing to lose..You're already divorcing him. Now if you catch him cheating you can take him to court for infidelity. GOOD LUCK!! I hope he isn't a violent person.

You can report it stolen if he took it without your permission. Did you tell him he could take it? Either way, it's in your name, it's YOUR car, try calling him and tell him to bring it back. If he refuses, call the police.

my husband is a police officer and he has advised me that as long as you are the only person on the loan and title than you can report it stolen
