found out by accident; loan is for $50,000 but is being paid; fraudulent claim has been submitted - waiting for report; person is a friend

Your choices are to turn them in to the police or pay it off yourself. And by the way...friends dont do that.

I actually know of someone in this same situation, who got it in writing from her that she had done this and how, and they have an agreement that the first time she is one second late with the payment, she goes to jail. The thing that really sucks is that until it has been paid for one year, it puts a hurtin on you when you, as a victim not pursuing legal action, need a loan for something, because you appear to be overextended....and no, a true friend would not do that.

First off, call the police! You could feasibly claim it was your car, was taken without your permission, and so you're reporting it stolen!

Less dramatically, you could file suit.

And NO, "person" is not a friend! If the loan is in your name, and they decide to stop paying, guess who the loan company will sue for the balance? YOU!

Go to the police today.
file a police report for Criminal Fraud and Theft of Identity. Contact the AG in area file report. Contact the bank holding the title notify of Fraud on the loan. Contact all 3 of credit reporting bureaus file fraud alert.
the person is not a friend - a criminal and thief - yes.
your credit rating and Your Name have been STOLEN. do it TODAY>

A rose by any other name is still a rose. This is called identity theft and it is not allowed by law.

However before you do anything given the complexities of such issues I recommend you talk to an attorney to make sure you are protected from any one else who might think you owe them money.

Report it to the institution it was taken out in (Bank for example). The person is not your friend if they are doing something fraudulent like this.

Notify the police and the District Attorney in your county. That is a major felony. The state should be notified as well so the police can impound the vehicle and confiscate the license plate.

Well, it was simple until you wrote person is a friend. Depends on how close this friend is. You may want to talk to him and find out why he did such a thing.

By the way, if he pays the loan in time, your credit history is going to improve. :)

I believe the previous poster, this individual isn't a chum! you ought to checklist this to all 3 credit reporting companies and checklist it! This individual would be paying this own loan now, yet what happens down the line if he/she loses his activity??? Your credit is ruined if this happens! besides the ingredient that that's unlawful!
