Depends on the law in the state-county-town you live in and what the person was doing on the property. If this is a peeping-tom then the person may be charged with a sex crime. If the person was on your property taking something, then is could be burglary or stealing. If the person had fire making materials, it could be attempted arson.

If someone trespassed you call the cops, even if you only learn about the trespass after it happened. Insist on filing a police report. If your property is damaged in the future that police report will help.

A friend of mine was metal detecting around a long abandoned civil war era hotel in field clearly marked "No Trespassing". The owner caught him and held him at gunpoint until the sheriff arrived who then arrested him. He was charged with unlawful trespass and some sort of theft charge because he was searching for artifacts. Both were misdemeanors but he did spend two weeks in county jail for it. This took place in rural Missouri.

I think if he came to harm you, you have the right to defend your self,, but if you don't have a fence and he just walk by on your property then you are paranoid,, you don't give any important details to give you a better answer.

AND WAS AQUITTED!

Let the trespasser beware!

It depends on how sane and level-headed the property owner is.

You can go to jail if you are given a warning, (i.e. sign or verbal warning).
