All I was saying is why do people whine about when a LOCAL Government says it is no longer legal to smoke in a bar or public restaurant. You call it unconstituional. I do not care if you want to smoke on your property because it is YOUR Property, if you want to smoke in your car or in your home that is your choice and your place so you have more than enough right to do it. Also if you want to smoke OUTSIDE in the public it is ok because there is not guarantee to clean air and it show cigarette smoke does not affect people who are outside. My problem is with people who scream unconstitutional when a local gov't says we no longer want to allow smoking in our indoor facilities that are open to the public. Note: private clubs like the Moose Lodge and the Elks club are exempt from this law or your local VFW lodge.

In order to serve alcohol in your premises you have to gain a liquor license. To prove you can properly dispense alcohol. I would be fine with doing the same thing for resaurants/bars who want to allow smoking. If a place has certain provisions then they can have smoking.

Second Dual Reality, I live in NY where they already have these laws and I have not heard of any cases where they did not allow smokers only bars where you had to be a private member to join. There is one that is down the street from me.

Second the government has controlled business that are open to the public for years. In the 60's most businesses did not allow blacks to eat in them it was through the local government that forced private businesses to allow anyone in the public in. The law does not say people who do smoke are not allow in it just says you can not smoke while inside.

What you are saying is that there is no such thing as privately owned business.
You fail to address the business owner who wants smoking allowed in the business he created but is controlled by a group of tyrants who want his legal choices controlled by an out-of-control mob.
Instead of trying to force a nanny government to control every aspect of every business on the planet, it would be easier and make sense for anti-smokers to just refrain from frequenting establishments where smoking is allowed. If anti-smoking establishments are so warranted, they would be a hit. Obviously, that is not the way it worked and anti-smokers demanded that the bully 'big government' do what they couldn't, which is to contol others and keep them from making their own choices.
Simple solution to a non-problem: mind your own business and let the next guy manage his.

If you are an owner of a bar/restaurant it should be your decision not the government. As a patron of a business you have the right to go into a smoking allowed place or not. A ban bars all smokers from a choice. I dont know where you are but when the smoking ban went into effect here the private clubs were included. Ban has since been lifted from all bars and clubs until the state votes. Which is the way it should stay.

The gov't is taking a step to controlling the rights of business owners...even if the owner changes their bar to a smokers only bar the gov't says no.
We had some bar owners who fired non smoking workers and establish a smoker club only membership..the gov't said no.
How far can the gov't go to tell you how to run your own business? Is the next step to ensure products that cause alergic reactions such as peanuts be banned from public places?
Or set drink consumption limits.
The list is endless..all they need is an excuse and a loudspeaker.

Response: If you live in NY then you have no ideas what laws are here in California...some cities have taken a step further and banned smoking on beaches, several yards from parks and schools..Santa Monica banned smoking outside as well...There is also no smoking within 20ft of an entrance of any door to a business or public facility. There is legislation to charge parents with child endangerment and make a misdameanor to smoke in a car or home if a child is present. There is also la bill running around to ban smoking in apartments and condos.
There has been a basic smoking ban for years. It just has bee getting tougher and tougher.

I am a smoker and have been a smoker for almost 40 years. I recognize my right to kill myself with cigarettes if I so choose. However, I also recognize the rights of nonsmokers to be able to socialize in a smoke-free environment. I have no problem with restaurants and bars being smoke-free. If I want a cigarette, I will go outside. The only problem I ever have is with people who feel it is their moral duty to tell me all about the dangers of smoking. I allow them a sentence or two, then ask them to change the subject, or I leave. I don't tell them how to live their lives, and I respect their right to congragate in smoke-free environments, and all I ask is that they respect my right to pick my poison.

The ban is hurting the economy. There are several bar/restaurant/pub type places that used to be packed that are now virtually empty. Smokers would rather eat their lunch outside where they can smoke.

I also believe its dangerous to have a smoking ban in corner bars. People now have to go outside to smoke and you cant bring your drink with you. This leaves drinks being unattended or leaving a friend behind to watch the drinks who could potentially be harassed by a drunk rapist.

people just feel like their world is closing in on them and they are taken out of their comfort zone,like the government is picking on them.but government has also went way beyond their charter mission and are now in the business of social engineering through means of creating laws and taxes that impact a particular group of what it considers misbehavior.

smokers have rights just as much as non smokers. the establishments should have the right to choose if they want smoking or not. why does the govt have to go after the smokers? why not the alcohol companies? more people die from drunk drivers than from smokers..... i have yet to hear of a person being killed because someone was smoking a cigarette.......just my opinion.

It's just a reaction from the addiction "oh my god they are trying to take away my power". I used to be one of those heathen smokers and I quit cold turkey 6 years ago. I am so embarrassed at how I must have smelled from the stench of cigarette smoke. You just have no idea until you quit.
