I went to pay rent yesterday and gave 16 days notice. They want me to pay for the remainder of the other 14 days. I didn't pay them at all. I figure they can just have my deposit which is $300 less than 1 months rent. So, when rent is late and I get a 3 day pay or quit notice, I can just leave within 3 days right? Can they sue me for the balance? Can they put this in my credit report? Can they file an eviction?

Forgot to mention they are slumlords. I requested major structural repairs 3 months ago and they haven't looked. There is mold in the bathrooms(reported over a year ago) and there has been vandalism in the complex. I found a place to move but have to move within 15 days and don't want to pay them for time I'm not living there.

they cant put it on your credit they could take you to small claims court for the balance but my guess is they wouldn't even bother for such a small amount

They can sue you for the difference in what you owe and such a judgement WILL appear in your credit report. Additionally, there may be charges for repairs, cleaning, and so on charged against your deposit of $300.

They will have no reason to file an eviction if you vacate the premises before they decide to do so.

yes, yes and yes. u didn't give proper notice, u need to give 30 days notice for vacancy. deposit is used just for that-damages done to the apartment. so for you not giving them proper notice and not paying the rest of your owed rent then yes you are liable AND THEY CAN SUE YOU FOUR THE REMAINDER. DO THINGS THE PROPER WAY SO THEY WILL GIVE U A GOOD REFERENCE FOR UR NEW PLACE.
