I believe they are still legally married if they have not signed divorce papers.

You've answered your own question. If they are not legally divorced then they are still married. Until one of them files the paperwork and gets it processed, they will remain so.

Yep they are still legally married, and she is entitled to what ever her widows part is if he passes away and they are still married. Even if he has a will leaving his things to all children, or children and or gf and such......because she is still married to him, she can claim her share of his estate.

They are still married until the go to court and sign some papers. They can't remarry until they do so. This also intitles your mother to his retirement, and all property. Same go for him... I would just take care of it, sign the papers and be done with it.
