If they handed you a bottle with another person's name on it, no, I don't think so. It's a given that you're going to read the bottle.

It is up to you to read all labels on medications before giving them to your child. You DO need to let the pharmacy know that it was the wrong dosage. Also let the doctor know. They may want to check them out to make sure it has not harmed them, but this is not something you should sue over. The courts are already full of lawsuits.

And you have never made a mistake? Even doctors and pharmacists are human and make mistakes. YOU are the one responsible for making sure your children get the correct medication.
If you want to pay an attorney for a case that is more than likely going to be dismissed, go ahead. I would say no.
