I was eating the chips and I reached in and grabed a few while wathing a movie, next thing I know is I bite into it and its a good size piece of hard plastic, and now my tooth hurts. I couldn't beleive it, cause it could have caused someone to choke.

Have your damaged tooth assesed, and sue only if necessary (i.e. you don't posses the funds to repair your tooth). If you do decide to sue, ONLY sue for the damages sustained from the plastic.

You need to contact the company first and foremost. They may have had a piece break off of their machine that bags the chips, and some child may get a hold of another bag that has plastic in it. They may ask you to send the piece or a picture of the piece of plastic to see if it is something that came from their factory.

save the chips, the bag, and the plastic. call them or write to them. they'll probably just send you a coupon. or.......... suck it up and deal. crap happens. at least you didn't break your tooth. don't even think about suing. america is getting worse by the day with all these money hungry sue happy people. it's just people trying to find the easiest, laziest way to get rich. that's america!

I can't imagine a lawyer wanting to represent you on this one. First, there are no damages; second, credibility is an issue b/c you could have made up the story about the plastic.

How long has your tooth been hurting? If it hasn't done any permanent damage I would just call them and tell them. You'll probably get a coupon for more chips.

Get your tooth looked at if it needs it and call the phone # on the bag so they can consider a recall of that batch of chips if they need to. Please don't sue. Our society is litigious enough already.
