ok my ex has my son for the school year...now i will be getting him for the summer...this is the first year of this arrangemet...previously I had him on the weekends and she had him during the week...my question is..should i still pay child support during the summer when i have him full time?? I'm not even asking for her to pay me during this time... I just dont think its fair to pay her when i have my son. What do you think?? And how should I bring this up without sounding like an *** to her?

Sorry but visitation and child support are 2 totally separate things. Read your divorce decree.

Yes it does sound unfair however if it is in the divorce papers that you pay child support then you still have to pay it even if he is with you. Unless you can go back and get the divorce amended (which you can) you still got to pay. My advice is go through the court and have it amended so that when your son is with you that you do not have to pay child support. If you pay your ex directly then you can work out an arrangement to where you don't have to pay her. If this is the case make sure you have a letter drawn up stating that you don't have to pay child support while your son is with you and make sure it is notorized!

It doesn't matter if the two of you agree or not. The order for support is a court order that neither of you can alter without court approval.

Even if you two agreed to do this, you would be in arrears and a judgement against you for the amount could be entered by the court.

Stick to the order.

Whatever your court order says is how you pay. If the order states that you will not pay for the period of time the child is with you, then you are not liable to pay. If it does not, then you pay. The order rules on these issues.

I totally agree with you and if she is understanding she will too, but you unfortunately have to do whatever the courts told you to do. You could ask the courts to ammend the agreement to include that. I think that'd be the only way.

it all depends-- are you doing this voluntarily- or - is there court papers mandating you to pay-- if there are court papers involved-- don't quit paying- because that will only get you in arrears- and you will get in trouble..
if its voluntarily- and you both decided this on your own- thats a different story- talk to the mother in that case.

unless you have the child support ammended in court, you do have to pay it
