a t-shirt brand that i really liked went out of business. can somebody start the business back up if it went under? do you have to buy it from the owner if they arent doing anything with it anymore?

They big question is WHY did it go under? If it is something that you could overcome, it may be worth taking it over.

Your answer lies in whether or not a trademark or copyright has been issued for that brand name. Neither a trademark nor a copyright expires with a bankruptcy. If such exists, you would have to negotiate rights to use that trademark (probably for money), and the proceeds from such payments would go to the bankruptcy court to further pay off debts.

Ofcourse you can, but if the company had a warehouse or store you may have to pay any outstanding bills they may have. I would also check with your local officals and courts to make sure everything is in order.

You have to check it out. Does is have patent on it? You can just start your own brand and logo and a little bit design twicking, you don't want to be just a kicker, right? You want to be as original as you can be.
