The court can decide the guardianship for a child of any age, of course they will choose his parents unless they are deemed unfit. If that is the case, the court will place the child with relatives or as a last resort in foster care. However, if a child simply wishes to live with the non-custodial parent then all he would need to do is file a motion in court to have the judge order a modification of custodial rights (that is if all are in agreement with the child's decision). Usually the court will listen to a child at most any age and consider his wishes, but especially once a child is in his teen-age years. The child's input weighs alot with the courts decision. My teen-age son decided to go live with his father once he turned13. He is now 16 and the court is doing a modification to the original custody now. Both parents have custody, only the primary residence has changed from one parent to the other.

Usually a child of age 12 will be heard by the judge. Child services may get involved if the child is making the request.

Even very young children can say in court or to their parents where they want to live, and it's taken under consideration. As the child matures, that carries more and more weight. However, until the child becomes an adult, he or she cannot have the last say.

Where I live at the age of 12 kids can have a say as to how much contact they want with the other parent especially if they have not had much contact in the past.

It depends on what state you live in. Here, in Washington state, kids have no say whatsoever until they turn 18.
