Okay...way to shock and awe the people with a stupid question.
BUT, there are cons to your arguement. leaking poison (which would be stagnant in the air) is differant than one puff of smoke.
I don't smoke...I really don;t intend to, but I never understand why everyone whines about it. Yeah, it sucks, for like 3 seconds, then once you get past the cloud youre fine. Walking past smokers wont give you cancer.
Here in Seattle we have laws about smoking in public. So, either make something like that work, or calm down and wear a gas mask.

It depends on the poison, the amount, and the reason.

Many times the way people deal with toxic substances is to simply burn them and put it in the atmosphere.

A lot of researchers work with toxic substances in fume hoods, and most the time they just pump the stuff out a pipe on the roof into the atmosphere.

What poison did you have in mind?

Depends on the poison and the amount. In plenty of cases, no. The exhuast from a car, for instance, is technically toxic, and not illegal. The smoke from a cigarette is less toxic than that coming out of the tailpipe of your automobile, but is illegal in some places.

ya, I know you are talking about smoking, so I'll say this: If I want to open a bar, and in my bar everyone gets to spray bug spray all over the place all night long it is my business nachos.

If you don't like my stinky bug spray bar, don't go there

update: OK, I'm down with that. I get to smoke anywhere I want, so long as I can beat up anyone who doesn't like it. Fair for me.

Does no one care about individual liberty any more?

I have yet to find research stating that brief exposure to cigarette smoke is hazardous.
