How can you serve someone custody papers as soon as possible, when you cannot find that person that needs to be served. What other sources can I go to that can help me speed this along, its been 2 months now since I've been trying to get my papers served, and it's costing me.

You've got to go the courts and formally notify them (not sure of the actual name for the form)that you are unable to serve this purpose because of reason x,y, or z. There's a paper you will have to fill out in the event that the person has disappeared or whatnot.

There is usually a thing called substituted service. You go to the court and convince them that serving on another person (such as a parent or sibling), or at an address will most likely come to the attention of the person you are trying to serve. If you do that it counts as service, and things can proceed.

If that person has already been involved in an action in thee court they may have filed an address at which they can be served. Service at that address is enough.

All this depends on the rules of the court. As you have not told us where you are it is pretty tough to help.

Depending on where you are, it can be handled by the sherrif's department for a set fee and milage. Contact your lawyer to see what can be done to get around this block. Published notice in the right place just might work.
