§ 14‑277.3. Stalking.

(a) Offense. – A person commits the offense of stalking if the person willfully on more than one occasion follows or is in the presence of, or otherwise harasses, another person without legal purpose and with the intent to do any of the following:

(1) Place that person in reasonable fear either for the person's safety or the safety of the person's immediate family or close personal associates.

(2) Cause that person to suffer substantial emotional distress by placing that person in fear of death, bodily injury, or continued harassment, and that in fact causes that person substantial emotional distress.

(b) Classification. – A violation of this section is a Class A1 misdemeanor. A person convicted of a Class A1 misdemeanor under this section, who is sentenced to a community punishment, shall be placed on supervised probation in addition to any other punishment imposed by the court. A person who commits the offense of stalking when there is a court order in effect prohibiting similar behavior by that person is guilty of a Class H felony. A person who commits the offense of stalking after having been previously convicted of a stalking offense is guilty of a Class F felony.

(c) Definition. – For the purposes of this section, the term "harasses" or "harassment" means knowing conduct, including written or printed communication or transmission, telephone or cellular or other wireless telephonic communication, facsimile transmission, pager messages or transmissions, answering machine or voice mail messages or transmissions, and electronic mail messages or other computerized or electronic transmissions, directed at a specific person that torments, terrorizes, or terrifies that person and that serves no legitimate purpose. § 50C‑5. Civil no‑contact order; remedy.

(a) Upon a finding that the victim has suffered unlawful conduct committed by the respondent, the court may issue temporary or permanent civil no‑contact orders as authorized in this Chapter. In determining whether or not to issue a civil no‑contact order, the court shall not require physical injury to the victim.

(b) The court may grant one or more of the following forms of relief in its orders under this Chapter:

(1) Order the respondent not to visit, assault, molest, or otherwise interfere with the victim.

(2) Order the respondent to cease stalking the victim, including at the victim's workplace.

(3) Order the respondent to cease harassment of the victim.

(4) Order the respondent not to abuse or injure the victim.

(5) Order the respondent not to contact the victim by telephone, written communication, or electronic means.

(6) Order the respondent to refrain from entering or remaining present at the victim's residence, school, place of employment, or other specified places at times when the victim is present.

(7) Order other relief deemed necessary and appropriate by the court.

(c) A civil no‑contact order shall include the following notice, printed in conspicuous type: "A knowing violation of a civil no‑contact order shall be punishable as contempt of court which may result in a fine or imprisonment." (2004‑194, s. 1.)

First off, you should NOT move. : ) Second, What in the hell is wrong with those people? Thirdly (and most important) Yes, file a lawsuit against the hoa and against the president personally. TODAY, go and file the restraining order. Just because he is the president of the HOA, does NOT give him ANY authority to enter your home or garage. EVER! My dad was pres of an HOA once. Fourth. Did you know that if you shoot someone INSIDE your house, it's considered self defense? Just make sure he is INSIDE your house. With the kids, you have an airtight case. Freakin pedophile! Suggest he was going to harm your dogs and your children. Glad your other neighbor was evicted, that some worry off your shoulders. Fifth. he was going to shut up your dogs? If they weren't barking, what EXACTLY did he mean. He's threatening your dogs! USE THAT AGAINST HIM! Seriously! Animal abuse is a crime. Sixth. The Cat will take care of it all for you. He's good at "taking care" of unwanted things, spiders, bugs and probably even people. Good luck!

I would spit in the face of a HOA like that. Yes I would get the restraining order and I would find the meanest sleazebag lawyer to threaten the hell out of the HOA and I would ceceed from said HOA. What the heck can they do to you? This is America, I would not join a HOA if I was the only neighbor in the whole county that wasn't in it. It's just one more attempt at people telling me what I can and can't do. I guess I'm funny like that but I mind my own business and I expect my neighbors to damn well do the same. If you think my grass needs cutting and would like to cut it for me, I'll be greatful and bend over backwards to help you in any way I can but don't dare knock on my door or send me a note to tell me I need to cut my grass or some crap like that! I work for a living and don't particularly care to have someone else line out my free time for me. I think I would have beat the man half to death if I caught him doing that at my house, in fact, if I were you, I'd probably be in jail right now for assault. I'm so sorry to hear you're having troubles and my best advice is to find a good lawyer. I wouldn't move and I wouldn't care if everyone in the neighborhood hated me. I would definitely have paid my last HOA dues after this and I would likely give the neighbors reason to think about moving! GOOD LUCK and I will be cheering you on. For the restraining order, go to your county courthouse and ask the Clerk of the District (felony) Court for the form you need to fill out. Usually they will guide you to a separate office, but it should be close by.

You will just have to fill in some information (your name and address, their name and address if known) and state why you think the person is a threat to your safety. If you have evidence, such as recorded phone messages or emails, take them along. If you have a witness, ask them to go with you. You will need to fill out the paperwork, and go before the judge. You will also have to file protection orders on each individual you consider a threat to your safety. Also, if other people need protection (your children, other family members) ask what needs to be filed.
