My husband twisted his back on the job and had to have a spinal fusion surgery. He felt better for a few weeks after, now he's in more pain than before. He can't even pick up our son. We are in a huge financial strain and are barely making ends meet. I don't know if his pain will ever go away. He's been hurt since last october.

My question is, should we sue? I don't want to be a money hungry person but my husband and I are in a real bind financially and he's in pain all day and night.

I always thought the people who sued were money hungry low lifes.... I don't want to be thought of as one of em.

He wasn't fired in fact if he can go back he will be promoted.

We do get WC checks and they are paying for all his medical stuff.

My concern was basically the suffering he's going through physically and mentally and the fact that if it's nerve pain that cannot be fixed what is he to do the rest of his life besides pop pain pills.

We receive WC checks but it's a third of his normal wages because he used to get OT and bonuses.

Unfortunately we live in a very litigious society. While you are thinking about whether you sue, ponder it under different circumstances. Would they immediately fire your husband if they were being sued for something he did wrong on the job? chances are yes. Would they sue him if he opened up a competing business in the same field? chances are yes. (trust me I know from experience). I did not sue my employer when I hurt my back at work, I even paid for the medical myself. When I left after the second time it happened, they sued me to keep me from working. We are 18 months in this now and over 20k, so my answer to you is : You are the victim, his employer has insurance to cover any lawsuits (liability insurance) specifically for this, If he doesn't sue the only winner here would be the insurance company.......You are not a lowlife for wanting to make sure your family is provided for...........Good luck and I hope your husband's pain goes away.......

BobbyK has it right.

First of all injuries such as the back, pelvis and such require much more than the standard time that doctors say. To truly recover can take months and months of doing nothing. And even if you feel better they can rear their head later in some way. The slightest bump later can bring it back.

This is a really, really big thing. You simply must take steps to assure the future of your family. You have to make the assumption that your husband will not be able to do the sort of work that he has done before. So he goes back to work..... well his case for disability is basically gone or at the very least difficult. No monthly payments and no money to learn how to do something else.

The company's insurance will take care of all of this so you simply must sue as there are too many things that could go wrong if he doesn't. You need to start writing down any call that you make and what was said. I understand the thought about not being money grubbing but what it comes down to is your future. Get a lawyer and get one now!

If your husband was injured on the job, he is entitled to Workman's Compensation benefits, medical benefit s and disability pay.

Has he been receiving Workman's Compensation benefits? Has he been receiving his regular paychecks? Has his employer paid his medical bills? Has he been fired from his job?

You really need to talk to the Personnel Manager of your husband's employers. He really deserves to have his needs provided for by the employer. If you do not get a satisfactory answer, then see a lawyer.

If the injury happened while your husband was performing his normal workplace duties then yes you should sue. Where I am from we call it 'workers compensation' and the employer is covered for this by his insurance.

i opted not to have the surgery because the doctors really have no idea what they are doing and i got them to admit it...you can get comp benifits retroactive . speak to an attorney specializing in this area

I think something went wrong during surgery. I don't think this is a frivolous lawsuit. You should talk to an attorney.
