Congress has the absolute power to declare war. The president has the power of the declaration of war as the commander in chief, but cannot declare a "war". The exception to this is that our current president has given himself the ability to declare war on a nation that was not at war with the United States.

According to the Constitution, only Congress (Representatives and Senators) have the power to declare war.
HOWEVER, President Truman sent troops to Korea to defend Seoul and the "legitimate" Korean Government, not by declaring war, but by fulfilling his role as Commander-In-Chief, which is what each President since Truman has done.

depends on which country you are talking about.
If you are refering to the USA then the president. In the UK it is officially the queen as war is declared in the monarchs name but effectively its the prime minister. (although Gordon Brown claims if he becomes PM he will give that power to parliament).
If you are speaking morally ...... i dont know.
