Those types of stories are out there. But they're far from dominating "every single Harry Potter fandom." The fandom includes people ranging from young children all the way up to retirees and grandparents in their 70s and beyond. There is a very large segment of fans who are in their late teens and 20s, though, and in my experience (having been among them for...several years now) these are the main fanfic writers. Those who write the more explicit stories are usually older (about 17 up into their 50s, with 20-somethings dominating), and they don't intend their stories for children to read. Just by the nature of the internet, though, it's not possible to completely prevent children under 18 (or 21, in some places) finding and reading the stories. Most of them make a reasonable effort to keep children from reading the stories- posting warnings and such that it's intended for an adult audience, and I'm familiar with several adult-oriented fanfiction archives that require users to register with a date of birth to "prove" that they're at least 18.

I wouldn't say that there are more "slash" stories set to Harry Potter, just that they are usually easier to find for some reason. (Slash is another term for yaoi- homosexual stories where two famous characters are paired together.)
I think the fandom that wrote these stories were predominantly inspired by the yaoi stories of Japanese anime & manga. The age range for this is pretty much 16 & up, and the author is almost always female, as is the target audience. (Most of the readers of such stories are almost entirely female, surprisingly.) Many of the stories aren't explicitly sexual, but the stories can range anywhere from longing to the actual acts.
Many authors use discretion & either post explicit content warnings about the material or post it within a forum dedicated solely to such stories. Some do not have this discretion (or common consideration) & post it without warnings & on forums where children could view it.
I used to read stories like these, but after a while they just got too much for me. Once, many stories focused on plot instead of sex, unfortunately many only focus on the pornographic elements.
As for 12 year olds being the majority of the HP readers, I'll have to say that I've seen more 16+ readers than the younger readers, since many have grown up reading the books.

I don't think they dominate... I don't know what net fandoms you're referring to, of course. http://www.fanfiction.net has a plethora of fanfics that aren't Harry/Draco.
I also doubt that 12 years old is the current average age of Harry Potter readers. I believe it is more around the 17-22 age range.
Most of the writers are most likely in their angsty mid to late teen years. Many teenagers will write about risque situations in general, both within and outside the realm of fan fiction, because it makes them feel rebellious and in-control of their own sexuality.
I, of course, don't condone them or think it's a good idea to put them online so that younger, unsupervised audiences can see it, because it is definitely a way for young people to be exposed to mature themes in a seemingly innocent package.

The main problem with slash fics is that the majority (probably 95%....more most likely) are written by females who have no clue what makes males tick.
That is the sad thing really since any pairing can be made to work....provided it is written well and not by starry-eyed fangirls (generally mid-teens to mid-twenties) who just write smut. Maybe they could try writing femslash since they should know what goes on in the mind of females.
I didn't used to mind reading the odd slash fic, but I don't bother anymore since the quality has gone downhill at a rapid rate of knots.

i think sirius/remus is more. which is good cuz i simply adore gay men anyway & love a good male/male romance fic now & then. ive even written an S/R...but..im not to good at writing romance...."shrugs"
