Every lease has an implied covenant of quiet enjoyment, whereby the landlord (or someone with paramount title) promises not to interfere with the tenant's possession or quiet enjoyment of the property. Interference with quiet enjoyment occurs when the there is a total eviction, partial eviction or constructive eviction.

Another such term is"warranty of implied merchantability." Best Buy sellsyou a TV.Theyare implying that once you unpack it, plug it in and hook up the antenna, it will work.

Quiet enjoyment means free from harrasment or as stated above from interference to enjoy. It is commonly misunderstood to mean "quiet" as in not noisy but it does not. It has to do with how the landlord relates to the renter but often people think it means free from noisey neighbors.
