It depends on the bank, but at the one I work at, in cases of bank error we always refund. If it is your first time overdrafting, we will usually refund a portion, if not all (depending on the amount of fees), of the fees. After that, you're on your own.

In the future, get a check register, and keep it!

If you mean on your taxes - No
If you mean from your bank, if this has only happened to you once in the last year many banks will waive the fee if you talk with them.
