the person is making no attempt to remove items even after contacting him and him making promises to remove, can we remove items as biulding has been broken into and we need to get his stuff out to repair said building

As far as I know, after 30 days, you may do as you wish with the belongings. I would call your local District Attorney to find out the law for your area.

If this person is not a tenant or anything why is his stuff there? You have a right to remove it right off the bat if that's the case. If he is renting that storage from another tenant or something you need to give legal notice.

You obviously know how to get in touch and who he is so send a registered letter with a due date for him to pick up his stuff. You can refer back to the original letter you sent him and say "You have had 45 days notice (or whatever it is) to remove your items and if not picked up by DUE DATE) they will be removed and disposed of.

If it's someone you can't reach a legal notice in the newspaper under LEGAL NOTICES will suffice.

"Owner of items stored at so and so you have until such and such date to remove items so building repairs can commence otherwise your items will be removed and disposed of."

Find out what your legal rights are for where you live if you are worried about it. Legal Aid can help as can the department that looks after Landlord and Tenant problems.

Local ordinances may vary, but if the person never had any legal right to be there or place items there you really have no obligation to safeguard or return the items. Sell or dispose of the items as you wish. You might even bill the offender for your trouble.

What is he thinking? What are YOU thinking?
You actually were nice enough to contact this person andlet him know you would like him to remove his things from your property? I would give him one more chance with a deadline on it like we need that stuff out by Tuesday at five pm since you are so nice to let him know.
Others would have had him arrested and taken possession of his stuff as compensation for their trouble. Since there is probably a lot more to this story you must be trying to help him out for some reason. But now you need to tell him out by such and such or i'll have to toss the stuff in the trash and charge you for the garbage pickup. Casually mention too that you could have had him arrested for what he did but you are trying to help him out although you don't have to.
