1) It is NOT a charity. I contacted them to ask about this some time go, and they said they could not get charitable status as such a charity "would not be for the greater good" meaning that it would ultimately benefit the McCann family. I can send you a copy of the email if you like...
I also received these emails from both Team McCann and Mark Warner Resorts:
a)THE EMAIL FROM TEAM McCANN:
"I fully understand that there are people out there who disagree with the way things are being run, but they quite frankly can exercise the fundamental human right of choice, and just choose not to donate money (and therefore don't have to spend their time worrying about how the money is being spent"
b)THE EMAIL FROM MARK WARNER RESORTS:
"Thank you for your email. I’m happy to reassure you that no public funds are being used to pay for the family to stay in Portugal, and that Mark Warner are happy to support them for as long as is necessary.Thank you for getting in touch"
So if their stay is being funded by Mark Warner why do they need the money? They are not employing private investigators to look for their child so why do they need the money? Why employ a QC if you're not being brought up on charges of neglect ? Didn't a member of their family say they needed the money for expenses which contradicts what Mark Warner has said..
2) Yes they can spend the money at will as it is a limited company that they have set up and therefore they do not have to account for the funds to anyone but the taxman.

3) Apparently they have been campaigning for donations.. including postal donation. See above links
They American Medical Association have also set up a Fund for them
4) They state that the unused funds will be used for other charities.. but if they make 3 million pounds from it all, they really are under no obligation to donate a penny,and if they do donate to charities it will most certainly be after they have paid themsleves, their fund managers, etc.. what will be left for charities wiill no doubt be a pittance
ADDITIONAL
5) In answer to your question why are they not being charged for neglect, I am studying Law and the law is clear on this matter. They have committed an offence under s 1(1) Childrens and Young Persons Act 1933. The fact that they committed this offence abroad is immaterial as there are reciprocal laws in place as we are part of the EU. Also Portugal has very strict child neglect laws. I suspect the Portugese are not proesecuting them as by doing so this could affect their tourist industry,,, social services inthe UK havenot flown out to Portugal simply becasue they are doctors and therefore "respectable" and exempt from the laws which applly to us all!

The only person/persons to blame are the predators that took little Maddie. I pray for her and her family everyday that she be safe, unharmed, not scared, and will be back with her mommy and daddy soon. My heart is breaking for them and I don't even know them. Something has got to be done with the laws in all of the countries across the world to stop these people from harming our children. Why not have them killed if they kill a child, chemically castrated if they rape or molest a child, and placed in prison for life with no possibility of parole if they abuse a child. These people will never be "healed" with therapy. Studies have proven that!

The company set up to collect money is NOT a charity. This is fact not conjecture. Once the money goes into the account, its the McCanns to spend at their will. They are not accountable for the money at all.
They are still being paid by the NHS as they are on leave.
They claim they will donate excess money IF Madeliene is found. The reality is not one single penny will go anywhere but on a fruitless search for Madeleine and to keep the McCanns on an extended holiday.

The McCanns are working on plans to visit a number of European cities to raise the profile of their daughter's plight.
They hope to go to Seville, Madrid, Berlin and Amsterdam in the near future.
A spokesman for the McCann family said the couple wanted to go to these countries because Spanish, German and Dutch tourists holiday in the Algarve.
Mr McCann also spent some time living in Amsterdam and has contacts there.
A private jet has been offered to the couple by a multi-million pound British entrepreneur.

The fund was set up to ensure that everything possible can be done to find Madeline! This includes her parent using it to fly to different countries! They are trying to get as much publicity as possible. Its all for Madeline though! They want her home safe more than we do!
Going to see the Pope won't bring her back any quicker but it keeps their faith alive.The fact that the head of the Catholic Church is praying for their little comfort is bound to bring some comfort to them! They are not 100% blameless but they deserve compassion! They made a mistake as we all do from time to time! The last thing they need at the minute is punishment for their mistake? Don't you think they're suffering enough at the minute?

the parents are to blame for leaving the kids in the first place.would they have left them in a house with electrical problems and thought it be safe 'cause they were only "50"metres so it couldn't set fire "'cause you never think it can happen to you." they left their kids alone so a pervert could take one of them and then they tried to cover themselves by constantly lying.good way to make money and gain fame they should be done for neglect.normal everyday people would be slated

I think our first concern should be the return and well being of Maddy. I don't think we should be to hard on the parents, they have enough on their plate. I don't know if anyone in the UK as ever stayed at Butlins or Pontins, or other holiday camps. Where parents would leave children and babies in their chalets. And a member of staff would walk round listening for any crying, and if they heard any they would make an announcement in the club or cinema. thousands of people used to use this method, Without any harm. I don't think they do it now. And I'm not condoning what Maddy's parents did. The trouble is we relax alot more on holiday. I'm sure her parents will never forgive themselves for leaving them alone. The person(s) to blame are whoever took Maddy.

They dont know whether to acceptthe pivate jet as they dont want to appear to be living a luxury lifestyle......bit late to think of that i think...so much for not leaving portugal

These thoughts did cross my mind too. I would assume that the funds are used to enable them to remain in Portugal and pay for expenses incurred in their search for their daughter. Any unused monies should be either returned to the donators or given to another charity for use.
I'm sure they're not using the money for anything other than this and I'm sure they must have advisors who are keeping an eye on how it is spent too.
