I am the mom of 3 beautiful kids and my ex is taking me to court and trying to get custody of the kids in order to try to stop me from moving out of state (through the permission of the court) due to the fact that I cannot afford it in CA becuase he pays little to no support. The only thing he does have on me is that my oldest is late to school often. I am trying to juggle raising three kids on my own and a full-time job (which he does not have). Is this something that could make me lose custody?

Yak Rider...thanks for letting me know the courts will "crack down" on me trying to get my kids to a better place where we can afford to live and that their drug addict dad may get custody of them. It is because of people like you that the justice system has these crazy loop holes.

Yes, you can. The courts have finally started cracking down on mothers who want to take their kids and move away from fathers.

****If your ex is that bad get his parental rights terminated by the court. Believe it or not, the court's job isn't to make things easy for you. The job of the court is to look out for the best interest of the children. If they've got a good relationship with their father then you have absolutely no right to break that relationship by moving them out of state. Like I said, if he's that bad then I'm sure you'll have no problem getting his rights terminated.

Your ex is going to look for ANYTHING to make you look bad, and lets face it, if he is not sending you support he looks pretty darn bad himself. I would make it a point to get the kid to school on time, before it goes to court. The kid isn't dressed in time, take him in his PJ's and have him dress in the car. A couple of times doing that and he will shape up. No your ex cannot have your kids taken away because they are late for school. You did not say how old he was. A judge will give older kids a certain measure of responsiblity for themselves and not put it all on your head. This is (an attempt at) intimidation on his part. Don't let the kids know he is doing/saying this, they do not need to choose sides.

Try to get your kids on time and prove that you could finance the expenses of your family. This way, you will not lose the custody of the children but it will be hard.

from tx-my husb's ex tried to move out of state and wewerejust able to stop her from moving.
of course-she didn't need the money-was remarried-and we were great parents.
it's what's in the best interests of the child that matters.
as far as being late-my kids choose to sleep in their clothes the night before school-and i figure b4 bo sets in-that's ok.

i am really troubled by the fact that you did not even try to explain wht the son was always late for school.that leads me to believe you are not doing a very good job
