I purchased a house. two rooms have no air. the contractor came out to look at it and fix it the first year after purchased, and in the process he fell thru the ceiling and never came back to fix it. can i now sue him. It is still not fix. I reported it to the homeowner ins. organization year 2, but they wanted me to pay 5,000.00 at the time and i did not have that kind of money. what should i do now???

Probably do no good suing, there is usually a statute of limitations! After 12 years, you're probably stuck, sorry! Good Luck, try finding a handy man to fix ceiling and air! Check to make sure that he has insurance and is bonded and licensed to work in your area! Also pay him at completion of job!

It will be difficult. The other side can argue that you are the cause of the damage(s) or that you accept these damages by staying at the place for 12 years.

I suggest cutting your losses and selling the place pronto.
This is a lesson for us all.
If you don't like something, resolve it immediately.
Even in a restaurant, if you find the food wrong, don't eat it till the bottom of the plate. Ask for it to be replaced or for a non-charge. Waiting so long will NOT help your case.

Fix it yourself and stop trying to make others do your work for you. You can sue anyone for anything, even sue me for this answer, but expect to get laughed out of court.
