He proved that he didn't want to be with her by not respecting her enough to either put himself out to stay together.
But it depends on if the ultimatum was reasonable enough and important to your relationship.
I think the person who refuses has ruined it (unless the ultimatum was really stupid)

Does it really matter? You are still left with a broken relationship. Ultimately, I would say you have both agreed to a wall you can not find a way around, so it would be mutual.
