My mother died and the house was in her name, she was paying the morgage on it every month and I lived with her until her death, how do I get the title in my name.

My hubby and I moved into this house "we" bought-my name wasnt on the mortgage loan. I didnt want my name on it b/c we werent married yet. Now, if I want my name on the mortgage then we have to refinance the original mortgage, pay closing costs (i.e.1month mtg, 1 month insurance, mortgage fees, taxes) (But, it is in his will that I inherit this house)
Your Mom is not able to sign. Yours is a different case and your best bet is to use an attorney who will work in your best interest.
Is there a will? If there isnt a will, but even something written on a piece of notebook paper stating from her that you were to inherit the house, or if there was a verbal statement from her for you to inherit the house, that is as good as a signature. You still have to refinance.
Some states, I think mine, if there is no will, the estate goes to the state.
Get an attorney. It is your best investment.

you need to contact a Title company.

If it is left to you in her will, or not have to go to probate court

You can not unless you refinance it.
